Terms & Conditions

I, the undersigned, am the parent/legal guardian of the above-named child and agree in utilizing Soneva’s Den facilities and/or babysitting services. I hereby acknowledge and agree to the below:

• The drop-off program at The Den is available to children above the age of 4 years who are able to participate in the program without requiring one-on-one attention. In the event that this is not the case, or where it is so requested by you, management reserves the right to charge a babysitting fee where close attention is required.
• If the child is under the age of 4 years, requires special attention, has any allergies, medical or physical limitations that forgoes the normal duties of our Hosts, we reserve the right to not accept the child into The Den unless accompanied by a parent/legal guardian.
• To ensure the health and safety of every child, please note that we will not allow children with clear flu/cold symptoms, lice, or any other such illnesses to enter, continue to stay in, or utilize services of The Den.
• The Den will not admit a child whose behavior is unacceptable or puts at risk their own safety or that of others.
• The Den Hosts shall not administer any medicine to a child without legal medical prescription. Where you request such administration of medication from the Resort, we may accept such requests at our sole discretion based on our capacity, and subject to you filling the required medical forms.
• Soneva advises against bringing valuable materials to The Den. In the case of loss and/or damage, The Den and Resort will not be held liable.
• It is strongly advised that, as legal minors, children aged 17 years and under are not authorized to sign themselves into/out of The Den. Children under age 13 must always be brought to and collected from The Den by an authorized adult.
• In cases where Barefoot Guardians are not permitted to collect the child from The Den, should a parent not collect their child before official closing hours, the child will remain in The Den, supervised by the Den Team, until the parent is located. The Resort reserves the right to contact/locate the parent and to charge a babysitting fee for any excessive time incurred.
• For health and hygiene reasons, any child/toddler using The Den pool who is not fully potty-trained is required to wear a swim diaper.
• The Den is a family facility and is not intended for adult use. Adults may only use the facility together with their children, and must adhere to all policies and procedures as instructed by the Den team. This includes no smoking/vaping, no alcoholic beverages, no photography/videography of any other children apart from their own.
• While we will make our best endeavor to attend to all children at the Den, the safety of children left solely in the care of the Den team will be our top priority over those children who are accompanied by their parents/guardians. Parents/guardians are allowed to utilize the Den facilities/program together with their children subject to agreeing here within to be fully responsible for the care and safety of the children and to not leave the children unattended at any point during their stay at the Den.
• In the event of property damage resulting from misuse and/or failure to comply with the Den team’s instructions, Soneva reserves the right to charge guests a penalty fee equivalent to the damage caused.
• That the above-named child can partake in all activities and consume food and beverage ordered by the Den team through In-Villa-Dining as part of The Den program, except where I have indicated otherwise above. Furthermore, by checking yes to the use of the zipline and/or climbing wall by your child, you effectively and voluntarily agree to the “Voluntary Participation, Waiver and Release Terms and Conditions” applicable to such activities, which are attached to this document.
• I recognize the risks of injury and harm that may occur to my child as a result of or during their participation/presence in The Den or the Den activities and facilities, and I assume such risks on my own for myself and my child as a condition of my child being permitted to participate.

Babysitting:

• That the babysitting services are provided solely for the convenience of the Resort guests, and use of such is at my own risk.
• That Resort personnel may not necessarily be professionally trained babysitters, and Soneva does not promise any warranty or representation in respect to the qualification of such babysitters or give any assurance as to the quality of service.
• That my child/children can use all villa and Den facilities within reasonable judgement while supervised by the babysitter, except where I have indicated otherwise above.

I release and hold harmless Soneva from any and all claims, demands, suits, costs, and charges in connection with or arising out of the childcare service, including, but not limited to, bodily harm or injury to my child(ren), except only for loss, harms or injury occasioned by gross negligence or intentional misconduct by Soneva. I hereby grant Soneva and its Hosts full authority to take whatever actions they deem necessary regarding my child’s health and safety in the event I cannot be reached or in the situation where time is of the essence, and I fully release Soneva and its Hosts from any liability in connection with those decisions.
